Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website at www.heartlandrestorationco.com (the “Site”), operated by Heartland Restoration Company LLC (“Heartland Restoration,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility and Acceptable Use

You must be at least 18 years old, or the age of majority in your jurisdiction, to submit a form or otherwise transact through this Site. By using the Site you represent that you meet this requirement.

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms
• Submit false, misleading, or fraudulent information through any form
• Interfere with, disrupt, or attempt to gain unauthorized access to the Site, our servers, or related systems
• Use automated means (bots, scrapers, crawlers other than legitimate search engine crawlers) to access or copy material from the Site
• Attempt to circumvent any access controls, including the staff-only owner portal
• Reproduce, distribute, or create derivative works from Site content except as permitted by these Terms

2. Estimates Are Not Binding Contracts

Information on this Site, including service descriptions, process steps, response-time targets, and any estimate generated through the Free Estimate request form, is provided for general informational purposes. Pricing, schedules, and scope of work are not finalized until set out in a written agreement signed by you and an authorized representative of Heartland Restoration. On-site evaluations may identify conditions that change the scope or cost of work.

3. Emergency Response

Heartland Restoration provides emergency restoration services and answers calls 24 hours a day, seven days a week. Response-time statements (such as “within one hour during business hours”) are best-effort targets and not guarantees. After-hours emergency response is subject to an additional fee. The Site is not a substitute for emergency services. If life or safety is at risk, or if you smell smoke or gas, leave the property and call 911 first.

4. Insurance and Billing

Heartland Restoration is an independent contractor. We do not hold direct-billing contracts with insurance carriers. We prepare estimates using Xactimate, the format most insurance adjusters expect, but the decision to approve, deny, or negotiate a claim rests with your insurer. Statements on the Site about typical insurance coverage are general information only and do not modify the terms of your policy. We recommend confirming coverage directly with your insurance company.

5. Licensing and Certifications

Heartland Restoration holds California Contractors State License Board license #1095366. Our team holds IICRC certifications including AMRT, FSRT, WRT, ASD, and CCT. License and certification status can be verified with the issuing bodies. Possession of a license or certification does not guarantee any particular outcome on a given project.

6. Intellectual Property

All content on the Site — including text, photographs, graphics, logos, the Heartland Restoration name and badge, and the underlying code and design — is owned by Heartland Restoration or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may view, save, and print pages of the Site for your personal, non-commercial use. Any other use, including reproduction, modification, distribution, public display, or commercial use, requires our prior written permission.

7. Project Photos and Gallery

Before-and-after photographs displayed on the Site depict Heartland Restoration projects. We do not publish customer names, addresses, or other identifying information alongside these photos. If you are a customer and would like a photo of your project removed from the gallery, contact us at glen@heartlandrestorationco.com and we will remove it promptly.

8. Reviews and Testimonials

Customer reviews and testimonials displayed on the Site reflect the views of the individuals who provided them and are not a guarantee of results on any other project. Outcomes vary based on the condition of the property, the scope of damage, and other factors.

9. Third-Party Links

The Site may link to third-party websites, including social media profiles and our Google Business Profile. We do not control those sites, do not endorse their content, and are not responsible for their availability, accuracy, or privacy practices.

10. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that the Site will be error-free, that defects will be corrected, or that the Site or its server is free of viruses or other harmful components.

Nothing in this section affects any warranty that cannot be disclaimed under California law, including any warranty attached to the restoration or construction work itself under a separate written agreement.

11. Limitation of Liability

To the fullest extent permitted by law, Heartland Restoration and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site or reliance on information contained on the Site, whether based on warranty, contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

In jurisdictions that do not allow the limitation or exclusion of liability for incidental or consequential damages, our liability is limited to the maximum extent permitted by law. Liability for restoration or construction services performed under a signed written agreement is governed by that agreement, not by these Terms.

12. Indemnification

You agree to defend, indemnify, and hold harmless Heartland Restoration and its owners, employees, and contractors from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising out of (a) your misuse of the Site, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

14. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Ventura County, California, and you consent to the personal jurisdiction of those courts.

15. Severability and Waiver

If any provision of these Terms is held to be unenforceable, that provision will be modified or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later.

16. Changes to These Terms

We may update these Terms from time to time. The effective date at the top of this page tells you when the Terms were last revised. Material changes will be posted prominently on the Site. Your continued use of the Site after an update means you accept the revised Terms.
